Rushed Impeachment by Unicameral National Assembly is Destroying Our Nation
National Assembly tabled impeachment motion on Dec. 3, 2016 and ratified it on Dec. 9. The entire process took just six days. There is no evidence of fierce debating taking place before the impeachment motion was passed. The only event that transpired was a vote. The entire process progressed at light speed.

An impeachment should not be pursed unless there is a precedent. Seeking to impeach a president in order to create a fresh precedent is tantamount to gambling with the fate of a country. When it comes to the impeachment process, the Republic of Korea lags behind Latin American countries in terms of the level of democracy. Such as rushed impeachment is unprecedented in history. It probably took more time for North Korean dictator Kim Jong-un to execute his uncle and eminence grise Jang Song-taek. We have witnessed barbaric act here in the Republic of Korea.

Impeachment was originally used in the U.S. to oust judges. And 15 out of 19 individuals who were impeached by the U.S. House of Representatives were federal judges. And the U.S. Senate upheld eight of the impeachment motions, which all involved justices.

In Latin America since World War II, the impeachment process has been used by parliament to oust presidents rather than judges. Nine presidents have been impeached in Brazil, Paraguay, Ecuador, Peru and Venezuela, as well as Indonesia and Lithuania. Brazil in particular impeached then president Fernando AffonsoCollor de Mello on corruption charges in 1992 and also impeached labor-backed President Dilma Vana Rousseff in August of 2016 on charges of violating accounting laws.

In Korea, then president Roh Moo-hyun faced impeachment in 2004 followed by President Park Geun-hye last year and both of their powers were suspended. This is not something to be proud of by any means. This show just how unstable Korean politics are. In other words, partisan clashes are common in Korean politics.

There are several characteristics that distinguish the impeachment process in Korea. First, the rationale for impeachment is quite unique. In Latin America, most of the rationale for impeachment involve corruption in the form of illegal campaign funding. Illicit political funds the president received during campaigning are revealed and opposition lawmakers use that as rationale for impeachment (in the case of Brazil's Rousseff, the president was accused of accounting law violations, but the crux lie in illicit campaign funds involving labor party heavy weight and ex-president Luiz Inácio Lula da Silva. In Lithuania, the president was impeached following revelations that he received campaign money from the Russian mafia. Illicit campaign funding can clearly serve as rationale for impeachment in a democratic nation, since such crimes damage fairness during elections.

The rationales for impeachment are quite unique in Korea. They do not involve illicit campaign funding, but are triggered by the mistakes made by the president's aides during the final year of his or her term. In the case of former president Roh, he got in trouble after making a comment asking the public to support his political party. For foreigners, that offense is a completely puzzling rationale for impeachment. Since the president is a politician, it may seem rather obvious for him to urge the public to vote for his party's candidates. But the Korean National Assembly used that action as an excuse to impeach the president. They felt that the president is a public servant and should refrain from voicing support for a particular political party or face charges of a constitutional violation.

That may seem to make sense from the standpoint of formal logic. But is it valid to apply to the president the same standards used on low-ranking public servants? From the perspective of a legal expert like myself, there is no constitutional precedent of a president facing impeachment for voicing support for a particular political party and being charged with violating the neutrality law as if he was a low-level civil servant. If there is no precedent, the impeachment option should not be used. Seeking to impeach the president in order to create a new legal precedent is tantamount to gambling with the future of our nation. As a result, the Constitutional Court struck down the impeachment bill citing common sense. The National Assembly ended up embarrassing itself. And even today, the National Assembly made an imprudent decision to impeach the president without a valid precedent. As a result, our country and the public have suffered huge losses.

The same goes for the impeachment bill targeting Park. At the crux of the impeachment bill against her is bribery to the tune of some W70 billion (based on the amount of donations big business conglomerates gave to the Mir and K-Sports foundations), which sounds like an astronomical sum on the surface. What country would hesitate to impeach a leader who has been found to have pocketed W70 billion in bribes? But a closer look reveals an entirely different story. As mentioned earlier, Park did not pocket a single penny. The National Assembly and prosecutors took issue with the donations received from businesses by the non-profit Mir and K-Sports foundations. They claim the president coerced the businesses into donating the money.

But most of that money is still held by the foundations and Park cannot be seen as receiving the funds. There were similar incidents involving previous administrations. But over the last 50 years, the National Assembly and prosecutors have not indicted previous presidents nor impeach them for accepting money. As explained earlier, ratifying an impeachment bill based on rationale lacking precedents is tantamount to a crime. In the end, prosecutors and the National Assembly are obstinately insinuating that the donations received by non-profit foundations are bribes given to the president and are using that logic to file bribery, coercion and abuse of power charges against the leader.

A key characteristic of impeachment proceedings in Korea is its speed. Unlike Korea, Latin American countries have bicameral parliaments. As a result, an impeachment bill must be ratified by both lower and upper houses of parliament. And a president's powers are suspended only after that process is completed. And a president is allowed to turn to the courts to seek to nullify the impeachment bill. As a result, the impeachment process takes at least several months. In the case of Rousseff, who was impeached recently, the Brazilian parliament discussed the prospect of impeachment for the first time back in 2014, about a year after she was re-elected into office. Two thirds of the lower house of Brazil's parliament supported impeachment in April of 2016, while two thirds of the upper house supported it on Aug. 31, which led to Rousseff's authority being suspended. And during that time, Brazil's parliament debated the impeachment bill scores of times and even gathered the opinions of the public. And Rousseff was impeached after a court rejected her application to nullify the bill.

What about Korea? We have a unicameral parliament and there is no chance for a lower and upper house to keep each other in check or to reconsider proposals. In the case of Roh, the problematic comment was made on Feb. 18, 2004. The National Assembly tabled the impeachment motion on Mar. 9 of that year and the bill was ratified only three days later. The same thing happened with Park. The National Assembly tabled the impeachment motion on Dec. 3, 2016 and ratified it on Dec. 9. It ook only six days. There is no evidence of fierce debating taking place before the impeachment motion was passed. The only event that transpired was a vote. The entire process progressed at light speed. Park did not even have a chance to explain her case. And the public was not fully informed about the events. Even today, I believe a majority of Koreans do not know the exact rationale for impeaching Park.

When it comes to the impeachment process, the Republic of Korea lags behind Latin American countries in terms of the level of democracy. Such as rushed impeachment is unprecedented in history. It probably took more time for North Korean dictator Kim Jong-un to execute his uncle and eminence grise Jang Song-taek. We have witnessed barbaric act here in the Republic of Korea. Unless we come up with laws to prevent the unicameral National Assembly from ratifying impeachments so quickly, we may end up witnessing the demise of our country due to the impromptu actions of lawmakers.
