미국 군사전문가들은 한국이 북한의 무인기 침범에 대응해 무인정찰기를 군사분계선 이북으로 보낸 것이 정당했다고 평가했습니다. 한국 내에서 논란이 되고 있는 정전협정 위반 여부는 유엔군사령부에 맡겨야 한다고 말했습니다. 안소영 기자입니다.
  
  해리 해리스 전 주한 미국대사는 북한 무인기 침범에 대한 한국 정부의 대응을 긍정적으로 평가했습니다.
  
  [해리스 전 대사]“It is right and proper for South Korea to defend itself against all incursions from the North, including establishing an anti-drone unit.”
  
  미 태평양사령관을 역임한 해리스 전 대사는 9일 VOA에 “한국이 ‘무인기 부대’ 창설을 비롯해 북한의 모든 침범으로부터 스스로를 방어하는 것은 올바르고 정당한 일”이라고 말했습니다.
  
  한국 정부는 지난달 북한 무인기 5대가 영공을 침범한 것에 대응해 RQ-101 ‘송골매’ 등 무인정찰기를 군사분계선 이북으로 보냈습니다. 이에 대해 한국 야당인 더불어민주당은 “남북 상호 간 영공을 침범하는 건 정전협정 위반”이라고 주장했습니다.
  
  하지만 한국 국방부는 9일 정례브리핑에서 정전협정 위반 논란과 관련해 “북한의 도발에 따른 자위권 행사 차원 조치로 유엔 헌장에서 자위권 대응은 보장하는 합법적인 권리이고 정전협정도 이를 제한할 수 없는 것으로 알고 있다”고 반박했습니다. 이와 관련해 해리스 전 대사는 한국 여당은 한국의 무인기 대응이 정전협정 위반이 아니라는 입장인 반면 야당은 위반이라고 주장하는 상황이 "이상하다"고 말했습니다.
  
  [해리스 전 대사]“I do find it odd that the ruling party would take the position that the drone incursions did not violate the Armistice while, at the same time, the opposition party believes the incursions are a violation. I will defer to the legal experts at UN Command whether this constitutes a violation or not.”
  
  그러면서 정전협정 위반 여부는 유엔군사령부의 법률 전문가들에게 맡겨야 한다고 해리스 전 대사는 덧붙였습니다.
  
  로버트 에이브럼스 전 주한 미군사령관은 ‘한국의 대응을 둘러싼 정전협정 위반 논란’에 대한 입장을 묻는 VOA의 서면 질의에 유엔사가 특별 조사팀을 꾸려 조사 중인 사안에 대해 언급하는 것은 적절하지 않다며 말을 아꼈습니다.
  
  [에이브럼스 전 사령관]”UNCMAC has directed a Special Investigation Team (SIT) to investigate the circumstances supporting the reported NK drone incursion south of the MDL and the ROK response. In my view, it would be inappropriate to comment on an ongoing investigation that has been rightfully/lawfully directed by the UNCMAC (see para 27 of the AA) to reports of potential violations of the AA.”
  
  “유엔사 군사정전위원회(UNCMAC)가 특별조사팀(SI)에게 북한 무인기의 군사분계선 이남 침범과 한국군의 대응에 관한 보도를 뒷받침하는 정황을 조사할 것을 지시했다”며 “군정위가 잠재적인 정전협정 위반 여부에 대해 정당하고 합법적인 조사를 지시한 사건에 대해 언급하는 것은 부적절하다”고 생각한다는 겁니다.
  
  에이브럼스 전 사령관은 향후 북한의 추가 무인기 침범에 대한 잠재적 대응과 관련해 한국에 단지 군사적 대응 이상의 여러 이용 가능한 선택 방안이 있다고 말했습니다.
  
  [에이브럼스 전 사령관]“As far as potential responses to any future nK drone intrusions, I believe there are several options available to the ROK which include more than just military responses. I purposefully left that open. Suffice to say there are more tools in the tool box that should be considered. We should all be mindful to avoid potential misunderstandings and miscalculations when responses are conducted”
  
  에이브럼스 전 사령관은 “도구 상자에 고려해야 할 도구가 더 있다”며 “대응이 이뤄질 때 잠재적인 오해와 오판을 피할 수 있도록 모든 것을 염두에 둬야 한다”고 덧붙였습니다.
  
  로렌스 코브 전 국방부 차관보는 9일 VOA 와의 전화 통화에서 정전협정 위반 여부보다는 북한 무인기 침입에 대한 한국 정부의 분명한 대응이 중요하다는 점에 무게를 뒀습니다.
  
  [코브 전 차관보]“The South Korean had to demonstrate that they could not let North Korea just get away with not only violating their airspace, but getting into toward their capitol. So they had to be like if we should be foolish enough to do anything, we aren’t afraid to retaliate.”
  
  코브 전 차관보는 한국은 영공을 침범했을 뿐 아니라 수도권 상공까지 진입한 북한에 그냥 넘어갈 수 없다는 점을 보여줬어야 했다며, 따라서 어떤 행동도 할 정도로 보복을 두려워하지 않는다는 입장을 전달했어야 했다고 말했습니다.
  
  브루스 베넷 랜드연구소 선임연구원은 북한의 추가 무인기 침입을 막기 위해 북한이 가장 꺼리는 방식으로 대응에 나선 한국 정부의 조치는 정당하다고 말했습니다. 다만 정전협정 위반 여부를 가리는 것은 단순한 일이 아니라고 말했습니다.
  
  [베넷 선임연구원]“So the charter is allowed by the armistice agreement. There are certain restrictions on the charter. In particular, if a solider on the other side of the line pointing a rifle at you, you are not supposed to shoot back at him unless he starts shooting or someone else along the line start shooting. In that kind of case, you are restricted. So this is a difficult question of whether or not it’s really a violation of the armistices.”
  
  베넷 선임연구원은 유엔헌장에 일부 제한이 있다며, 특히 반대편에서 소총을 겨누고 있는 군인이 있어도 그가 먼저 총을 쏘거나 다른 누군가가 총을 쏘기 시작하지 않는 한 그에게 사격을 가해서는 안된다고 말했습니다. 따라서 정전협정 위반 여부는 어려운 질문이라고 말했습니다.
  
  데이비드 맥스웰 민주주의수호재단 선임연구원은 한국 내 남남갈등을 유발하고 분열을 초래하는 게 북한의 의도라며, 한국의 자위권은 결코 부정할 수 없다고 말했습니다.

The armistice does not trump the right of South Korea to defend itself from North Korea to include responding with kinetic force, if necessary to defend South Korea. So technically, South Korea is correct that it can provide a proportional response to North Korean activities in the North Korea sent drones to the South to conduct reconnaissance.”
  
  맥스웰 선임연구원은 “정전협정은 필요할 경우 무력 대응 등 한국이 북한으로부터 자신을 방어하는 권리를 제한하지 못한다”며 “따라서 정찰을 수행하기 위해 한국에 무인기를 보낸 북한의 행동에 한국이 비례적으로 대응하는 것이 옳다”고 말했습니다. 다만 이로 인해 빚어진 정전협정 위반 여부 논란은 북한이 바라던 바라고 덧붙였습니다.
  
  [맥스웰 선임연구원]”They are playing politics and using these activities and these events to discredit the other political party. So we really need to understand North Korea’s political warfare strategy and not play into that.”
  
  맥스웰 선임연구원은 북한이 이런 활동과 사건들을 정치적으로 이용하고 있다고 지적하며, 따라서 북한의 정치전 전략을 이해하고 이에 이용돼서는 안된다고 강조했습니다.
